Distance Selling regulations governing financial services agreements
1. Right of withdrawal:
1.1. Except as indicated below (Sections 1.2 and following), with regard to distance selling of financial products and services, you have a cooling-off period of fourteen (14) calendar days in which you may withdraw from the agreement without the need to justify your action and without being subject to penalties. This short period of time begins on the date the distance sales agreement was signed.
If you decide to exercise the applicable right of withdrawal, you must give notice of your decision by sending a registered letter with return receipt to the following address: Barclays Services, 183 avenue Daumesnil, 75575 Paris Cedex 12, France. (insert hypertext link)
1.2. If you enrol in a life insurance policy or guaranteed investment contract, the 14-day right of withdrawal is not applicable, but you have a right of renunciation for thirty (30) days starting on the date on which you are informed that the policy or contract was made. The insurance proposal explains the procedures for exercising this right.
1.3. With regard to home loans governed by Articles L 312-2 and following of the French Consumer Code, the 14-day right of withdrawal does not apply. The borrower and guarantors have an acceptance period of ten (10) clear days following receipt of the loan offer. The procedures for exercising this right are defined in the offer.
1.4. The 14-day right of withdrawal does not apply to the provision of financial instruments referred to in Article L. 211-1 of the French Monetary and Financial Code or to the receipt/transmission and execution of orders on behalf of third parties referred to in Article L. 321-1 of that same code. Consequently, once the purchase/subscription order has been carried out in accordance with your instructions, you no longer enjoy the option of cancelling the transaction.
1.5. The 14-day right of withdrawal does not apply to agreements fully executed by the two parties at the express request of the consumer before the consumer has exercised his or her right of withdrawal.
2. Language used: Communications during the precontractual relationship between you and our institution and as the agreement is being prepared will be in the French language. The language used during the contractual relationship that you and our institution have mutually agreed is French. However, you may come to an agreement with your relationship manager that the language used will be English.
3. Applicable law and assignment of jurisdiction: The precontractual relationship and the agreement are governed by French law. Accordingly, French courts alone will have jurisdiction.
4. Complaints In the event of a problem, you should first contact your Relationship Manager by any appropriate means: directly at the branch, by telephone, post, fax or e-mail.
